Refund policy and right of withdrawal

1. Purpose
This policy explains the rules applicable to refunds, cancellations, immediate access to educational video materials, guided online workshops, in-person workshops and the right of withdrawal on LESSUNS.
2. Distinction between withdrawal and commercial refund
The right of withdrawal is a legal consumer protection in certain distance sales. The refund policy defines the cases in which VAO Agency or the Teacher may grant a refund or an alternative solution, in particular in the event of a technical problem, failure of the announced support, cancellation of an in-person workshop or a goodwill gesture.
3. Guided online workshops, video material and loss of the right of withdrawal
Guided online workshops and packs of guided workshops may include educational video material accessible immediately or shortly after purchase. To access the digital material of the service immediately, the Student must give their express agreement and acknowledge that they lose their 14-day right of withdrawal once access has begun, where the law permits.
Unless a more favourable or different indication is displayed on the offer page, each guided online workshop automatically includes access to messaging with the Teacher and individualised feedback. The Student has a standard period of 30 days from purchase to request this feedback, unless a different period is indicated in the offer.
Feedback may be provided by message, video, comment, live session, group session or any other announced format. If the Teacher does not respond according to the displayed terms, VAO Agency may send notifications or reminders and analyse the Student's request on a case-by-case basis, without automatic refund.
Mandatory checkbox: I expressly request immediate access to the digital material of the guided workshop purchased before the end of the legal withdrawal period and I acknowledge that, once access has begun, I lose my 14-day right of withdrawal.
4. In-person workshops on a specific date
In-person workshops correspond to leisure services provided on a specific date or period. Where the applicable law so provides, these services do not benefit from the 14-day right of withdrawal.
Before validating the booking, the Student is informed of the date, location, price, access conditions and applicable cancellation rules. Common LESSUNS rule: unless a contrary legal obligation, cancellation of the workshop by the Teacher, duly justified force majeure or a more favourable rule displayed by LESSUNS applies, the Student may request the cancellation and refund of an in-person workshop booking up to 14 calendar days before the workshop start date. After this 14-day period, or where the booking is made less than 14 days before the workshop date, the Student's absence, lateness or change of mind does not give rise to an automatic refund.
In-person workshop bookings may be made via the web or via the iOS application. Where a booking is made via the iOS application, the App Store's rules on payment, technical cancellation, refund and adjustment may also apply.
5. No refund after access to the content
Where the Student has obtained immediate access to the educational video material of a guided workshop and has validly lost their right of withdrawal, no refund is due solely on account of a change of mind, a lack of availability, an incompatibility with personal expectations or a failure to fully consume the material.
6. Cases opening a refund review
a technical problem attributable to LESSUNS genuinely preventing access to the material or essential features;
absence of access to messaging or absence of the announced support, after reasonable notifications or reminders that remained ineffective;
double payment, obvious billing error or unauthorised transaction;
material or offer withdrawn before effective access, where no reasonable alternative solution is offered;
cancellation of an in-person workshop by the Teacher or inability to perform;
request to cancel an in-person workshop by the Student received at least 14 calendar days before the workshop start date;
legal obligation;
an Apple or Stripe decision according to their rules;
a goodwill gesture granted on a case-by-case basis.
7. Technical problem
The Student must contact support with the relevant information: account concerned, content, purchase date, screenshot, error message and device used. VAO Agency may first attempt to resolve the problem. If access remains impossible for a cause attributable to the platform, a refund or an alternative solution may be offered.
8. Student subscriptions
A subscription to a Teacher may be cancelled according to the terms of the subscription channel. Save for a legal obligation or a goodwill gesture, cancellation does not entail a pro rata refund. Access to the support, the included workshops, messaging and associated features remains, in principle, open until the end of the period already paid for. In the event of a payment failure, a grace period may be applied; failing regularisation, access may be suspended.
9. iOS purchases
Purchases made via the App Store are subject to Apple's rules. iOS refund requests may be processed by Apple, according to its own criteria and time frames. An Apple refund may result in the cancellation of access and the adjustment of the Teacher's revenue.
10. Impact on Teachers
Any refund, chargeback, fraud, cancellation or adjustment reduces or cancels the share payable to the Teacher. If a payout has already taken place, VAO Agency may charge the amount against future revenue or request the return of amounts wrongly received.
11. Time frames and terms
Requests must be addressed to eric@lessuns.app. VAO Agency reviews requests within a reasonable time. The refund, where granted, is made via the initial means of payment where this is technically possible, subject to bank, Stripe or Apple time frames.
12. Fraud and abuse
VAO Agency may refuse a refund and suspend an account in the event of an abusive request, fraud, circumvention, unauthorised sharing of the content, video extraction, identity theft or breach of the terms.
